Again I chuckled at the wheel barrow.
LOL I just saw John with that. What we’re they going to wheel outta there?

I think the were planning to put the dirt they dug up in it, this way the could just dump it back in the hole.

I am ok with Sami wanting them arrested, even if it's just to aggravate them. John knew that Sami had been called, he knew Sami was on her way home. He should not have agreed to dig that grave up with Paul (the person who was about to marry Sonny), he should have waited for Sami to get back & had Marlena reason with her. Will is Lucas & Sami's son, it's their decision to make, not Paul's. As a soap fan I know this is just a plot point, but John did irck me with this action. I already don't accept shinny Paul as John's beloved son, so having him dig up Sami's son's grave and put Pauls's needs first really bothered me.
I went and watched Friday’s show again, including the 15 min I missed because of news, and rewatched Monday’s show too. John did not know Sami was called or on her way. When she came up on them as they were about to start digging and told them not to even think about it, John said: “Samantha, I had no idea you were in town.”

Only because she stopped them. A crime was still committed because there was intent and tresspass.
It's a public cemetery. It's not a crime to walk around in public with shovels and a wheel barrel.
They werent just walking around with shovels though. They were seconds away from digging up someones grave. John was literally about to dig when she grabbed the shovel. So theres a difference.

My bad, he didn't know. Either way it was wrong & even he knew that, that's why he never protested against Sami's rage.

Thats true but its still a crime in the eyes of the law. Consider this: I put 2 shovels in my car and drive to a public park where I know youll be because my intent is to knock you out with the shovel. Right as Im about to hit you, someone grabs the shovel. So I didnt actually do anything but dont you think I should be arrested?

Depends. Did you actually swing the shovel towards her head? If so, that's an attempted crime. If you were just standing there planning to do it and somebody distracts you, then there is intent with no attempt and it's much murkier.

In this case, it's a public cemetery so it's not trespassing. Possession of shovels and a wheelbarrow is not illegal. They had the intent, but were denied the opportunity to actually attempt the crime. Because it's not a crime that is a threat to life or limb, it's unlikely that anybody would prosecute it as an attempted crime.

I am a lawyer. :)

And sure, you could make the argument. I don't think there is any prosecutor that would bother with pursuing the case though.

After 17 years, Eric and Nicole are still the most damn tortured couple on this show....ugh so damn gut wrenching....this cannot be the end for them....it's pure utter agony watching them today😩😩😩😩😩😩
