Cease and desist letters are pretty common in the legal field, especially with regard to intellectual property stuff. If you have a trademark that you feel someone is infringing on, then normally the company will send a letter to the alleged infringer making them aware that they are infringing on the trademark and warning them if they don't stop then they may take legal action. Really, what else can the WGA do to the alleged non-union writers in this situation? At the most, the WGA could have a cause of action against Days but I don't see how they could have any individual cause of action against the individuals. It is not like the individuals have broken any law and it is not like the individuals have any contractual relationship with the WGA. |

Well hopefully this can end with the cease and desist letter and Days will just get a huge warning for this...I don't want Ed and anyone else who helped write to get punished..I'm fine with a strong warning.. |

The cease and desist just means for all FUTURE writing. From here on out, they have to stop. That doesn't mean the case against the writing that's already been done has been dropped though. That's a separate issue. I'd still like to hear a statement from Corday/Days. But I pretty much doubt that'll happen. |

There is no way that a writer's union could have that kind of control to stop a show from production. Even if violations were found by Days, I don't see how they could control the production. They are simply a union who have some workers that are employed by Days and with whom Days has a contract. Days may have violated the contract but it has not broken any laws. If real trouble is to come, it would come from the executives at NBC, Sony, etc. |

I would hope whoever they replace her with puts an end to all these couples, I'm getting a headache trying to keep up with who is with whom. I would like Ejami to finally get together after this mating dance of two years, but who knows at this point. And I hated the way Higley is writing Nicole. Nicole is best being comedic relief, maybe the new writer can get us back to that. |

Hopefully, it's just the warning and it's heeded and we can all move on. That would be the best case scenario. I always believed the diva and other actors involved would get off with a slap on the wrist. It's Scott and Higley who may not be so lucky. |

Is that it, really? Like they can avoid the whole mess with Ed and the diva by just informing them to stop? Is it that easy? I really hope so! Hopefully, Higley leaves, ES and diva et all get wrist slaps and Higley's writing team can take over until new headwriter is hired. Can it be that easy? Oh, Pearly...I am so glad you have Kelly Taylor up over that other chick. I really couldn't stand Keira! ;) |

It just warns them to stop from here on out. If there's still proof of PAST non-union writing, they can still pursue that and fine people. But it basically says "We know what you're doing. From here on out, it better stop, or legal action will intensify" Edited by brimike, Jul 29 2008, 01:19 PM.
